School understands and hereby acknowledges that School has reviewed and approved the Program(s) listed above and hereby adopts the Program(s) as its own with respect to the administration of the Program(s) by School. School understands and hereby acknowledges that School is and shall be entirely responsible for the administration of the Program(s). In consideration of the financial contribution made by CIJE, School hereby (I) releases CIJE, its affiliates, officers, and directors (the “Released Parties”) from any and all liability arising out of the School’s administration of the Program(s), and (ii)indemnifies and holds harmless CIJE, its affiliates, officers and directors for any and all claims and expenses, including attorney’s fees, arising out of or relating to School’s administration of the Program(s), such indemnity to include, but not limited to, claims by or on behalf of School’s students, faculty and staff and anyone contracting with School for the provision of any goods or services.
School represents and warrants that School will secure general releases from all School participants in the Program(s) (each a “Participant”) for School to use each Participant’s name, likeness, voice, and statements attributed to such Participant (“Material Containing Participant”), in any manner, in any and all media now known or hereinafter invented, including but not limited to the Internet and social media platforms, in perpetuity, worldwide for the purposes of creating, publishing and broadcasting advertising/promotional/merchandising for CIJE (”Advertising”) without any limitations. School shall cause Participant to agree that Participant shall have no right to approve any such Material Containing Participant. School shall cause Participant to represent and warrant that Participant has the legal authority to enter into such release agreement and to grant all rights therein in and to the Advertising without violating the legal or equitable rights of any third party, and that CIJE’s use of the Advertising shall not require payment to, or additional permissions from, any third party. School shall also cause Participant to represent and warrant that the statement(s) and information attributed to Participant and any modifications thereof by CIJE which do not alter the spirit or integrity of such Participant’s opinion, may be used in any advertising, marketing or promotion, that they accurately reflect Participant’s opinion, and the statements made are known to be true and are based on personal familiarity with Participant’s participation in the Program(s).
School agrees to release, discharge, indemnify, defend, and covenant not to sue the Released Parties for any and all claims, damages, liabilities, suits, demands, costs, expenses and actions of any kind whatsoever (including reasonable attorneys’ fees and court costs), which may arise from or in connection with school’s participation in the program(s), including, without limitation (a) any property damage, personal injuries, disability, death or other damage suffered by school, the released parties, or any third party, whether caused, in whole or in part, by the sole or concurrent negligence or wrongdoings, strict liability or fault of the released parties, school or otherwise; or (b) any breach of this release of any violation of law by school.
School understands and acknowledges that CIJE has not arranged for and does not carry insurance of any kind for School’s benefit relative to School’s participation in the Program(s). School understands and acknowledges that School’s participation in the Program(s) is wholly voluntary and School is fully aware of the inherent hazards, dangers and risks involved, including death, disability, injury and/or property damage. School agrees that use of lab and motorized equipment involves many obvious and not-so-obvious risks, dangers, and hazards, which may result in injury or death to School employees, students, or others, as well as damage to property and that such risks, dangers, and hazards cannot always be predicted or avoided. School agrees that such risks, dangers, and hazards are School’s sole responsibility. School agrees that if its participation in the Program(s) causes any injury or damage to another person or property, then School is solely liable for all resulting injuries, damages, and related costs.
